Lawsuit Sparks Changes in Subway's Sandwiches


BRIDGEPORT, CT

Subway is now measuring all of its “footlong” subs in response to a 2013 class-action lawsuit that alleged the sandwich chain was snubbing its customers by one inch.

All franchisees are now required to use measuring devices to ensure that footlong subs are 12 inches and 6-inch subs are no less than 6 inches.

The settlement agreement states that Subway had engaged in “unfair and deceptive marketing practices regarding the length of both Six Inch and Footlong Subway® sandwiches.”

Two years ago, the chain was criticized after a photo that showed a footlong sub measured closer to 11 inches went viral across social media.

Regular compliance inspections will be conducted, generally monthly, to determine that the baked breads measure at least 12 inches long. In addition, all training materials will be revised to include a requirement that all baked breads for footlong sandwiches must be 12 inches.

Subway has denied the claims, explaining in the settlement agreement that it will “never be able to guarantee that each loaf of bread will always be exactly 12 inches or greater in length after baking.”

A hearing to approve the settlement is scheduled for January.
